May 26: Petaling Jaya again hosted the Blackout 505 rally series, which held its ninth mammoth gathering at Padang Timur or Dataran Petaling Jaya, attracting more than 80,000 people who filled every inch of the iconic landmark.
The rally, called by Solidariti Anak Muda Malaysia (SAMM), kicked off at 5.00 pm amid drizzle, with a short break which saw the field as well as spaces inside the nearby Amcorp mall making way for Muslims to perform the Maghrib prayer. By 9.00 pm, tens of thousands were already sandwiched in the field with thousands more stranded at nearby entry points including at the Taman Jaya LRT station.
Civil society groups, individual activists and top Pakatan Rakyat leaders including PAS's deputy president Mohamad Sabu and youth chief Nasrudin Hassan addressed the crowd. The rally concluded just before midnight with a fiery speech by Anwar Ibrahim who again vowed not to concede victory to BN in the controversial general election.
The focus of last night's attacks by speakers was the Election Commission, with many banners condemning its head Abdul Aziz Mohd Yusof and deputy Wan Ahmad Wan Omar.
In recent times, the duo have been placed at the centre of growing calls for the EC's resignation, and last night appeared to be the clearest message by protesters.
In his speech, Anwar urged for a mass lodging of police reports nationwide by those who witnessed fraud on polling day, saying this would further dismiss the denials by EC and BN leaders of electoral fraud.
"At the very least, by this Monday, lodge a police report on the problem with indelible ink," he said.
On the election petitions which PR was preparing, Anwar said Malaysians should have no illusion of justice, saying the 'people’s court' was the better judge.
"You want to know about the courts, you ask Anwar," he said. "But we will go through the procedures. And we will keep gathering and we will not be cowed by your threats," Anwar added in a warning directed at Home minister Ahmad Zahid Hamidi who had in the run-up to the latest rally warned the public that they were breaking the law.
Anwar said EC deputy chief Wan Ahmad’s claim that GE13 was clean and fair was a blatant liar, calling him a liar "of evil proportion".
"Let me make it very clear. We won the elections, and no way we will ever concede this government to the illegitimate Najib’s government. They have stolen lands, stolen tolls, stolen AES (Automatic Enforcement System), and now through the EC they have stolen our rights. Every voter has been cheated.
"We will fight them, and fight them hard. We will never surrender," he stressed.
SAMM chief Badrul Hisham Shaharin announced the search for 500,000 volunteers in the movement to press the authorities to address electoral fraud.
He also vowed to mobilise a protest in front of the EC office to press for resignation of the commissioners.
"We will sit-in there until the resignation of EC members,” he added.

Saya mengecam kenyataan Suruhanjaya Pilihanraya (SPR) melalui Timbalan Pengerusinya Datuk Wan Ahmad Wan Omar yang menyatakan bahawa kejadian Blackout 505 yang tersebar di internet dan akhbar adalah fitnah dan lakonan yang dirakam sebelum PRU 13.
Ternyata hasil penelitian dan siasatan awal yang dilakukan beliau bersama pegawai-pegawainya adalah sangat lemah dan hanya sekadar ingin menutup kelemahan sistem pilihanraya yang ada dan menafikan kejadian blackout yang benar-benar berlaku. Saya ingin menyatakan bahawa gambar yang tersebar tersebut adalah benar dan kejadian itu berlaku di SEKOLAH KEBANGSAAN SERDANG, di bilik pengiraan undi Saluran 3. “Counting Agent” kami telah mengambil beberapa gambar sebelum dan selepas kejadian blackout tersebut itu berlaku.
Saya juga melihat beberapa kelemahan Timbalan Pengerusi SPR dalam menilai beberapa aspek dikatakan Prosedur Operasi Standard (SOP) SPR sewaktu hari mengundi pada 5 Mei 2013 yang lalu. Bagaimana beliau sendiri tidak tahu pakaian rasmi petugas-petugas SPR berwarna kelabu pada hari tersebut. Saya juga berasa hairan kerana beliau juga tidak kenal kotak bekas kiraan undi yang digunakan oleh pihak SPR sendiri. Gambar tersebut dengan jelas menampakkan logo SPR di tepi kotak kiraan undi yang digunakan.
Sewaktu kejadian itu berlaku, wakil calon kami juga telah berusaha membekalkan lampu suluh ke bilik kiraan undi tersebut bagi memastikan proses kiraan undi berjalan dengan lancar. Saya menafikan bahawa terdapat wartawan di lokasi kejadian kerana yang ada hanya Ketua Tempat Mengundi (KTM), petugas SPR, wakil calon dan anggota polis yang bertugas.
Oleh itu, saya menyarankan agar pihak SPR khususnya Timbalan Pengerusi SPR Datuk Wan Ahmad Wan Omar memohon maaf kepada seluruh rakyat Malaysia kerana telah melakukan kesilapan dalam mengeluarkan kenyataan tanpa membuat kajian yang mendalam dan mengambil ringan isu yang dibangkitkan oleh rakyat. SPR sebagai badan rasmi yang menguruskan pilihanraya ini mesti dilihat profesional, adil dan telus serta tidak berpihak kepada mana-mana parti.

Zahid (right) and the IGP have been accused of concentrating the police’s resources on an apparent opposition crackdown. — File picKUALA LUMPUR, May 27 ― Home Minister Datuk Seri Ahmad Zahid Hamidi and Inspector-General of Police Tan Sri Khalid Abu Bakar are dragging Malaysia back into the “dark era” of the Mahathir administration by clamping down on dissenters, a PAS leader said today.
PAS vice-president Salahuddin Ayub told HarakahDaily the duo’s action against the opposition and the spates of arrests under the repressive Sedition Act were reminiscent of the authoritarian rule of then prime minister Tun Dr Mahathir Mohamad.
“While (Datuk Seri) Najib Razak will be remembered as the first prime minister for a minority government, Zahid and Khalid on the other hand will be remembered as two figures who are dragging Malaysia back into the dark era of Dr Mahathir,” the PAS organ quoted him as saying.
Last week, two Pakatan Rakyat (PR) leaders and two activists were arrested for sedition while the Home Ministry also carted off over 1,000 copies of PAS organ Harakah from shops and several distribution centres in what was seen as a crackdown on the opposition.
Student Adam Adli was the first to be detained while PKR’s Batu MP Chua Tian Chang, activist Haris Ibrahim and PAS’s Datuk Thamrin Ghafar Baba were arrested a few days after.
Several PR leaders are also under police investigation for their involvement in a series of rallies held nationwide to protest what they allege to be electoral fraud during Election 2013.
“When I spoke last Wednesday before supporters who were protesting the arrest of Adam Adli, I told them Adam should not have been arrested. He was harmless, he did not carry weapons, burn houses or instigated people to do things that threaten public security.
“So did Thamrin, Tian Chua and Haris. They did not ask anyone to carry out an armed insurrection,” the former Kubang Kerian lawmaker said.
Adam Adli was charged with uttering a seditious statement at a May 13 forum where he allegedly questioned the results of Election 2013 and called on Malaysians to take to the streets to boot Barisan Nasional (BN) from Putrajaya.
According to charge sheet, his words had a seditious tendency and were aimed at rallying Malaysians to change the current government through undemocratic means.
His statement, originally issued in Malay, said: “Take my details, lodge a police report, because today, I would like to invite all those here today to gather and take to the streets to seize back our power! Can we do that? Can we do that? Can we do that? We do not have much time left, get ready, buy shoes, buy tracksuits, buy jeans, get ready to take to the streets because in a third world country like Malaysia, elections cannot topple a government.
“Only the people’s power can topple a government. Remember, ladies and gentlemen, this is the only opportunity we have.”
Charged under Section 4(1)(b) of the Sedition Act 1948, the Universiti Pendidikan Sultan Idris undergraduate faces a jail term of not less three years, or a fine of up to RM5,000 or both, if convicted.
Authorities have not charge the three PR leaders but their arrests are believed to be in relation to the same forum.
Leaders from the opposition bloc have blamed the clamp down on Zahid and Abdul Khalid, whom they accused of being more interested in political manoeuvring than doing their job to curb rising crime.
Salahuddin echoed the view and asked why Abdul Khalid was ardently “victimising” PR leaders.
“While his own sister was robbed and the sibling of the deputy prime minister’s house was broken into, Khalid should be focusing on tackling crime and not do other things to please the Umno warlords,” he said.
Salahuddin insisted that the allegation of PR-backed plot to topple the government through street demonstrations was fictitious and created to justify the clampdown on a strengthening opposition.

PETALING JAYA, May 24 — Pakatan Rakyat (PR) has claimed the alleged irregularities found in the contest for the Balik Pulau seat alone could prove that the May 5 general election results had been rigged, a leader from the federal opposition pact said today.
The discrepancies included proof that there were more votes cast than the number of ballot papers issued by the Election Commission (EC) as well as video evidence of vote buying, violations that PKR strategic director Rafizi Ramli (picture)claimed had contributed to Barisan Nasional’s (BN) marginal win in the contest for the Penang federal seat.
“This incident proves that the votes cast had exceeded the number of ballot papers issued did happen.
“It happened in Balik Pulau and it is certain that it happened in other places, although having all the reports on this compiled by #siasatpru13 would be impossible,” Rafizi, who is also the newly-elected Pandan MP, told reporters at the party’s headquarters here.
#siasatpru13” is a taskforce set up by Rafizi to spearhead PR’s efforts to gather all evidence of polls irregularities as the bloc prepares to petition the Election 2013 results soon.
PKR had lost the Balik Pulau parliamentary seat contest by a slim majority of 1,539 votes. It had also lost two of the three state seats within the constituency, Telok Bahang and Pulau Betong, with marginal majorities of 801 and 395 votes respectively.
In the copies of the “Borang 13” distributed to the media, the first-term PKR lawmaker showed how the EC had in one polling district recorded 424 as the number of ballot papers issued while the number of votes cast totalled 562, which means there was a discrepancy of about 140 votes.
Rafizi note that if all the polling districts in the constituency had encountered the same alleged manipulation, it was likely that the extra marginal numbers could have given BN the majority it needed to wrest the seat back from PKR.
Rafizi said the number of extra votes in each of the 28 polling districts could have been between 138 and 318.
There was also a case where the EC had added a state seat contest result into the figures for a parliamentary seat, a mistake that has cast a spotlight on the polls regulator’s ability to implement elections fairly and efficiently.
Meanwhile, PKR claimed it had video evidence showing voters purportedly queuing to collect cash in a small Chinese food stall in a rural location within the constituency.
One clip showed a poster with all the codes of state seats PR had lost in Penang written on it and pasted on a closed railing of a shop in what appeared to be an indicator of where voters could collect their cash for helping BN win in these areas.
Newly-elected Bayan Baru PKR lawmaker Sim Tze Tzin, speaking at the same press conference, said seven and three separate complaints have been lodged with the Malaysian Anti-Corruption Commission (MACC) and the EC respectively.
“It is impossible that the MACC could not find the culprits involved as the exercise would involve a lot of manpower and resources,” he said.
Rafizi said his party would consider including the evidence in the election petition and continue to expose them to the public.
BN and the opposition now have 21 days to file election petitions as the EC gazetted the official results of the 13th general election yesterday.
BN secretary-general Datuk Seri Tengku Adnan Tengku Mansor said the coalition’s lawyers were scrutinising the results where the BN won or lost by a slim margin.
PKR vice-president Chua Tian Chang said the party would likely file 27 petitions involving parliamentary and state constituencies, and co-ordinate the action with allies DAP and PAS.

Salmiyah Harun, 24 Mei 2013 KUALA LUMPUR: Timbalan Presiden PAS Mohamad Sabu menyifatkan Menteri Dalam Negeri Datuk Seri Dr Ahmad Zahid Hamidi sudah panik apabila cuba memberi amaran jangan menghadiri himpunan aman SuaraRakyat 505 esok.
Katanya, Zahid sepatutnya menawarkan diri untuk berdepan dengan rakyat yang mahukan kebebasan bersuara bukannya berselindung di sebalik polis.
"Zahid bukannya hendak berdepan dengan rakyat, sebaliknya berselindung di belakang polis. Dia bukan pemimpin yang berani sebab guna polis," katanya kepada Harakahdaily.
Zahid dilaporkan memberi kenyataan amaran kepada mereka yang berhasrat untuk menghadiri himpunan anjuran NGO esok.
Katanya, pasukan polis akan mengambil tindakan tergas biarpun terpaksa "membayar dengan harga yang mahal".
Sementara itu, Mohamad mengesahkan akan hadir esok sebagai peserta himpunan tersebut.

PENGERUSI
Suruhanjaya Pilihan Raya (SPR) Tan Sri Abdul Aziz Mohd Yusof berkata
mereka yang tidak berpuas hati dengan keputusan pilihan raya umum ke-13
(PRU13) boleh memohon semakan supaya pilihan raya diadakan semula
dengan mengemukakan petisyen selepas pewartaan keputusan oleh SPR,
mengikut undang-undang.
"Selepas diwartakan dalam tempoh 21 hari, mereka boleh buat petisyen, itu yang betul dan kalau bukti-bukti itu jelas serta lengkap dan pihak hakim mengakui wujudnya perlakuan rasuah, penipuan atau menyalahi undang-undang, maka mungkin Hakim Mahkamah Tinggi berkenaan akan memutuskan bahawa keputusan pilihan raya itu tidak sah," kata Aziz.
Sentimen yang sama juga diluahkan oleh Presiden Umno Najib Tun Razak. Najib menyatakan Umno akan terima apa sahaja keputusan mahkamah.
Inilah skrip basi SPR dan Umno. Bagi kedua-dua tokoh ini penyelesaian kepada kepincangan sistem pilihanraya adalah mahkamah. Hujah Najib dan SPR ini hakikatnya satu lagi bentuk penipuan halus pihak berkuasa untuk mengelirukan mereka yang jahil tentang petisyen pilihanraya.
Saya ingin nyatakan dengan tegas petisyen piliharaya dan mahkamah bukan penyelesaian kepada kepincangan pilihanraya. Alasannya cukup mudah. Mahkamah pilihanraya (election court) beroperasi dalam ruang lingkup undang-undang pilihanraya yang digubal oleh rejim BN yang korup dan penipu. Jadi bagaimanakah undang-undang yang digubal oleh rejim yang penipu dapat menyelesaikan pilihanraya yang sarat dengan penipuan !!!
Ibarat yang mudah adalah bagaimanakah kita boleh mengharap kambing selamat dari serigala jika yang jaga kambing adalah serigala !!!
Dalam undang-undang pilihanraya, alasan pembatalan sesuatu pilihanraya hanya boleh dibuat oleh hakim pilihanraya melalui seksyen 32 Akta Kesalahan Pllihanraya 1954. Seksyen 32 menggariskan lima alasan [ 32 (a) hingga (e)] bagi pembatalan pilihanraya oleh Mahkamah Pilihanraya.
Najib dan SPR arif dan tahu berdasarkan seksyen 32 (a) hingga (e) Akta tersebut hampir mustahil untuk membatalkan sesuatu pilihanraya. Bagi memudahkan faham mari kita lihat bagaimana seksyen 32 (b) Akta tersebut digubal oleh rejim BN.
Berdasarkan seksyen 32 (b) tersebut sesuatu pilihanraya hanya boleh dibatalkan jika mahkamah pilihanraya berpuashati wujudnya perlanggaran undang-undang pilihanraya namun perlanggaran itu mestilah dalam masa yang sama menjejaskan keputusan pilihanraya.
Sebagai peguam yang banyak terlibat dalam petisyen pilihanraya saya ingin nyatakan membuktikan perlanggaran undang-undang atau peraturan pilihanraya bukan suatu yang susah kerana Umno dan SPR seringkali langgar undang-undang pilihanraya. Malahan banyak kali kami peguam PAS dapat membuktikan hal tersebut.
Yang sukarnya hingga ke tahap hampir mustahil adalah membuktikan perlanggaran undang-undang oleh Umno dan SPR boleh menjejaskan keputusan pilihanraya.
Hakim–hakim di negara ini sehingga sekarang memilih tafsiran kuno tentang maksud menjejaskan keputusan pilihanraya. Di negara maju seperti di England para hakim di sana berpendapat jika berlaku perlanggaran undang-undang secara substantif maka pilihanraya adalah tidak sah tanpa mengira perlanggaran itu menjejaskan atau tidak menjejaskan keputusan pilihanraya.
Tafsiran mahkamah di Malaysia berdasarkan tafsiran matematik. Contohnya jika calon A yang kalah dengan majoriti 1000 undi dapat buktikan wujudnya perlanggaran undang-undang misalnya dakwat tidak kekal di jari pengundi, calon A kena buktikan 1001 pengundi yang dakwat dijari mereka tidak kekal dan kesemua 1001 pengundi itu kena juga dibuktikan telah mengundi dua kali.
Jika tidak dibuktikan meskipun calon A boleh buktikan penggunaan dakwat yang tidak kekal adalah bercanggah dengan undang-undang namun pilihanraya yang langgar undang-undang itu masih dikira sah dan tidak boleh dibatalkan.
Itulah yang hakim-hakim di negara ini akan putuskan. Jika hakim putuskan begitu Najib dan SPR secepat kilat akan berkata “lihatlah mahkamah telah pun memutuskan pilihanraya adalah sah..jadi mengapa Pakatan Rakyat masih tidak puas hati?”
Bagi saya ini satu muslihat licik Umno untuk menggunakan saluran mahkamah untuk menjustifikasi penipuan!!!
Sebab itu saya tegaskan mahkamah atau petisyen bukan jalan penyelesaian kepada kepincangan sistem pilihanraya. Mahkamah rakyat adalah penyelesaiannya.
Bagi rakyat jika SPR atau undang-undang kata dakwat yang digunakan adalah kekal maka SPR kena pastikan dakwat itu benar-benar kekal. Jika tidak kekal maka SPR tipu. Undang-undang juga tipu.
Inilah perbezaan mahkamah pilihanraya dan mahkamah rakyat. Di mahkamah pilihanraya hakim tidak boleh batalkan pilihanraya meskipun SPR tipu kerana hakim terikat dengan undang-undang yang digubal oleh rejim penipu.
Sebaliknya di mahkamah rakyat keadilannya lebih tulen. Jika SPR dan undang-undang tipu maka pilihanraya yang BN menang adalah pilihanraya tipu. Maka PM dan Menteri yang dilantik juga dikira oleh rakyat dikira sebagai PM penipu dan menteri penipu !!!!

Rafizi kumpul 8 saksi Kejadian Kad Pengenalan Digunakan Oleh Pengundi Hantu Di Seluruh Malaysia
Mulai hari ini, #siasatpru13 akan mula menampilkan bukti-bukti yang mengesahkan bahawa Pilihanraya Umum ke-13 dicemari dengan penipuan dan penyelewengan terancang yang berleluasa di seluruh negara.
Setiap minggu, #siasatpru13 akan mengadakan 2-3 sidang media untuk membawa bukti ini kepada rakyat. Selain dari bukti-bukti yang ditunjukkan, #siasatpru13 juga akan membawa saksi-saksi terbabit untuk menampil memberikan keterangan.
Penyelewengan yang paling berleluasa adalah kehadiran pengundi hantu yang berpunca dari daftar pengundi yang tidak bersih. Perkara ini membayangkan kelemahan dan mungkin keterlibatan dua badan yang bertanggungjawab, iaitu Suruhanjaya Pilihanraya dan Jabatan Pendaftaran Negara.
Kehadiran pengundi hantu membawa impak yang besar yang meruntuhkan keyakinan rakyat kepada integrity keputusan PRU13. Apabila pengundi hantu wujud, segala keputusan – dari undi majoriti, peratusan keluar mengundi, pola pengundian mengikut saluran dan lain-lain – diragui oleh rakyat.
Setakat 17 Mei 2013, 8 orang pengundi telah tampil dengan laporan polis yang dibuat kerana mereka dihalang dari membuang undi apabila orang lain telah pun mengundi menggunakan nama mereka. Ini bermakna wujud kad-kad pengenalan palsu yang dikeluarkan oleh Jabatan Pendaftaran Negara yang telah diberikan kepada individu tertentu bagi tujuan menjadi pengundi hantu.

Laporan polis yang telah dibuat berhubung perkara ini disertakan bersama.
#siasatpru13 sedang dalam proses untuk mendapatkan persetujuan pengundi-pengundi ini untuk membuat Akuan Bersumpah (Statutory Declaration) mengenai kejadian ini untuk mengukuhkan lagi bukti yang ada.
Wujudnya kad pengenalan berlainan untuk membolehkan orang lain mengundi dengan menggunakan identiti seorang rakyat Malaysia yang sah adalah amat membimbangkan. Ia bukan sahaja mengesahkan kehadiran pengundi hantu di dalam PRU13, tetapi membayangkan kegagalan Jabatan Pendaftaran Negara menjamin bahawa kad pengenalan adalah tulen, selamat dan unik kepada setiap rakyat Malaysia.
Fakta bahawa pengundi hantu wujud kerana identiti rakyat Malaysia digunakan oleh orang yang tidak dikenali untuk mengundi tidak boleh dinafikan oleh sesiapa. Pun begitu, saya mencabar SPR dan Jabatan Pendaftaran Negara untuk mengemukakan alasan mereka untuk dihakimi oleh mahkamah rakyat.

By Ida LimPETALING JAYA, May 20 — PKR’s Rafizi Ramli today offered evidence of phantom voters, which he alleged was widespread fraud that could potentially “discredit” the recently-concluded general election, besides putting the integrity of Malaysia’s identity cards (IC) in doubt.
“The moment you have similar IC used by different people, so much so that the genuine or actual person proving the identity is denied to vote, that means this is part of a bigger planning to allow phantom voters to come in,” the PKR strategy director said at a press conference.
Rafizi (picture) listed eight people who had approached PKR about being denied their right to vote as others had already voted in their names, while also showing reporters the police reports which he said they had lodged voluntarily.
The Pandan MP said that these complaints were also made in the constituencies where the federal opposition Pakatan Rakyat (PR) had won, which he said showed that the alleged electoral fraud was “widespread” and “systemic”.
These eight voters were registered to vote in the parliamentary seats of Serdang, Sungai Petani, Shah Alam, Tumpat, Kemaman, Kuala Selangor and Rembau, Rafizi said.
He disagreed that these eight cases could be due to technical errors on the part of the Election Commission (EC) staff on polling day, or attributable to lost ICs falling into the hands of the alleged phantom voters, saying that some of the complainants had said that they had never lost their ICs.

PKR's #siasatPRU13 team, which is collecting evidence of electoral fraud and is led by Rafizi, will also get these voters to make Statutory Declarations (SD) to affirm their complaints.
But Rafizi said that such evidence has bigger implications than just proving the existence of phantom voters in the electoral roll, claiming that the National Registration Department (NRD) had failed to guarantee that the country’s ICs are genuine and unique to all Malaysians.
“What comfort do we have that our ICs are now not subjected to counterfeiting, not subjected to fraud, where people can have multiple ICs to do various things with different identities?” he asked.
Rafizi challenged the NRD and the EC to answer these complaints, later urging newly sworn-in Home Minister Datuk Seri Ahmad Zahid Hamidi to look into the allegations of fake ICs.
In Sabah, a royal commission of inquiry (RCI) today resumed its hearings on the state’s illegal immigrants issue and allegations that foreigners were given citizenship in exchange for their votes.

Testimonies given by former high-ranking NRD officers during the RCI hearings had previously cast a spotlight on the government department.
During today’s press conference, Rafizi also said that the party will hold regular press conferences to reveal more evidence of electoral fraud, with such information to be spread through the use of leaflets and videos as well.

Ambiga said the tribunal will gather evidence of polls fraud. — File picKUALA LUMPUR, May 21 — Bersih 2.0’s “People’s Tribunal” may not have any legal standing but will serve as a “moral force” to investigate allegations of electoral fraud, said Datuk Ambiga Sreenavasan when defending the polls watchdog’s final attempt at proving wrongdoing in the May 5 polls.
The renowned civil rights activist told The Malaysian Insider that Bersih 2.0 will soldier on with its plan to set up the tribunal which, she said, should be announced in two or three weeks’ time, despite earning condemnation from polls regulator Election Commission (EC).
“It is true that it is not set up under any law or statute. That is why it is called the People’s Tribunal,” she said.
“It will be an evidence-gathering tribunal and what we have is the moral force to examine the allegations. That is its main aim — to gather evidence,” she added.
On May 6, a day after the tumultuous 13th general election, Bersih 2.0 announced its plan to set up the tribunal to look into the hundreds of reports of alleged cheating that took place during the polls.
The coalition of over 80 non-governmental organisations insisted that the polls results had favoured the ruling Barisan Nasional (BN) largely because of these irregularities, and said it would not recognise the outcome until it had verified all allegations of fraud.
In the polls, BN continued its half-a-century unbroken rule and emerged victors yet again despite winning with a significantly smaller seat majority in the 222-seat Parliament.

The ruling pact snapped up 133 seats this time to Pakatan Rakyat’s (PR) 89, failing yet again to recapture the coveted two-thirds parliamentary majority that it first lost in the 2008 general election.
PR refused to accept its losses, however, pointing to the fact that it had won the overall popular vote by scoring 51 per cent of votes cast, while BN only took 48 per cent — an outcome reminiscent of the 1969 polls when the ruling pact first lost the popular vote.
The federal opposition pact of PR has since confirmed plans to file election petitions to challenge the results in 27 federal seats where BN had won with marginal majorities, allegedly due to electoral fraud.
PKR strategy director Rafizi Ramli has also said that the same complaints will be brought before Bersih 2.0’s “People’s Tribunal” where, he said, PR’s evidence was likely to be treated with more seriousness than in any court of law.
Ambiga told The Malaysian Insider that the tribunal will be presided over by a five-member panel, which will include individuals of repute and who will not be members of any political parties or even from Bersih 2.0 itself.
She said the panel will likely come up with a set timeframe to conduct its probe, apart from deciding on appropriate terms of reference before commencing any hearing.
“We will then expect some sort of recommendations or findings to be made. This will be presented to all the relevant authorities, including human rights bodies like Suhakam,” she said.
“For Bersih... our role is just to facilitate the setting up of the tribunal. Further to that, we will not get involved. It must be completely independent,” she added.
Ambiga also explained that the setting up of the tribunal was taking longer than originally planned due to the complexity of its scope of investigation, as well as the selection of its panel members.
“We originally wanted to have it done by June but it looks impossible at this point. We should announce the panel within two or three weeks’ time.
“But as to when the panel will begin their hearings, that would be entirely up to the members to decide,” she said.
Despite widespread protests against its handling of the 13th general election, the EC has insisted that it had conducted the polls fairly and successfully, citing the higher turnout of voters at a whopping 84 per cent as evidence of voters’ confidence in the Malaysian electoral system.
“We have conducted a successful polls, there was an 85 per cent turnout… we have good job as you can see from the turnout,” EC deputy chairman Datuk Wan Ahmad Wan Omar said last week.
PR has been organising mammoth rallies across the country to prove voter dissatisfaction against the polls, which PR de facto chief Datuk Seri Anwar Ibrahim has insisted had been stolen from his pact.
